I have just reproduced the bug, and I believe it to be the original window has no documents open.

Steps to reproduce:
1) Close all tabs in current Scratch window
2) Close Scratch
3) Open Scratch via Plank icon right click menu selecting New Window
4) 2 Scratch windows will open
