I've tested this and can confirm the fix. I did the following:
* Booted a Hardy Live CD (in vbox), installed and launched oem-config and confirmed that I could close it in mid-pre-install causing badness
* Enabled proposed, updated oem-config (and ubiquity for good measure)
* Launched sudo oem-config from the terminal and confirmed that the close X button is no longer available
* Continued with the rest of oem-config (which cowardly refused to update the initfamfs on my live CD :)
I'm slightly confused by the fact that the changelog refers to oem-config 1.38 but proposed only has 1.37.2
