The Debian EEE PC team (http://debian-eeepc.alioth.debian.org , http://wiki.debian.org/DebianEeePC) has created a package, madwifi-eee containing the patched version. It builds on Hardy after I built a new version of madwifi-tools 1:0.9.4~rc2+dfsg-1 from Debian lenny. (Hardy only has 1:0.9.3+dfsg-3, and madwifi-eee requires > 1:0.9.4~rc2+dfsg-1).

Any chance we could see a new updated madwifi-tools for hardy, and then the madwifi-eee packages included so that EEE (and other AR5007) users aren't left in the dark?
