wpa_supplicant it's CPU hog and generate errors

Bug Description
wpa_supplicant eats lot of CPU resources and generate repeated errors:
iwl3945 0000:03:00.0: Radio disabled by HW RF Kill switch
This error appears even if WiFi switch is set to off.
'sudo modprobe -r iwl3945' disables wpa_supplicant and errors stop.
If I switch WiFi on and connect to my hotspot everything back to normal.

I have just tested the 3.9.0 kernel- generic- 030900rc3 and the problem still exists.
